In compliance with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, we inform you that Tertech Lab, SL, with registered office at Costa d’en Paratge, 22 2n., D-1, 08500 Vic (Barcelona) - Spain, and VAT number B42721720, registered in the Barcelona Commercial Registry, Volume 47,695, folio 149, sheet number B-559.642, entry 1st, is the owner of this website.
DATA CONTROLLER
Any personal data we may collect directly from the data subject will be treated confidentially and incorporated into the corresponding processing activity owned by Tertech Lab, SL.
PURPOSE OF PERSONAL DATA PROCESSING
Tertech Lab, SL, in accordance with Organic Law 3/2018 on Personal Data Protection and Digital Rights Guarantee and EU Regulation 2016/679, informs you that if you send us an email to the address indicated or complete any data collection form, the personal data you provide will be processed and incorporated into processing activities for which Tertech Lab, SL is responsible, with the purpose of:
- Managing your inquiry
- Offering our products and services
- Maintaining a business relationship
- Sending, by any means (including email or equivalent electronic communication), advertising or promotional information about the Company’s products or services, provided that prior consent has been obtained
Tertech Lab, SL declares that it has adopted all necessary and appropriate security measures in accordance with EU Regulation 2016/679 and Organic Law 3/2018, and has implemented all technical means within its reach to prevent loss, misuse, alteration, unauthorized access, or theft of the data provided.
PRINCIPLES APPLIED TO DATA PROCESSING
Principle of lawfulness, fairness and transparency: We will always require your consent for the processing of your personal data for one or more specific purposes, which will be communicated to you in advance with full transparency.
Purpose limitation: Data is collected for specific, explicit, and legitimate purposes and will not be further processed in a manner incompatible with those purposes.
Data minimization principle: We only request data that is strictly necessary in relation to the purposes for which it is needed — the minimum possible.
Accuracy principle: Data will be accurate and, where necessary, kept up to date.
Storage limitation principle: Data will be retained no longer than is necessary for the purposes of processing, depending on each purpose.
Integrity and confidentiality principle: Your data will be processed in a way that ensures appropriate security and confidentiality. We take all necessary precautions to prevent unauthorized access or misuse of user data by third parties.
Accountability principle: Tertech Lab, SL is responsible for complying with the above principles and will adopt the technical and organizational measures necessary to demonstrate compliance.

DATA RETENTION PERIOD
At Tertech Lab, SL, we aim to ensure that the personal data provided is kept only for as long as necessary to fulfil the purpose for which it was collected and to determine any potential liabilities arising from that purpose.
Data retention criteria: Data will be retained for the period required by law, as long as there is a mutual interest in maintaining the purpose of processing, and when it is no longer necessary for that purpose, provided that the contractual relationship remains in force, and unless the data subject requests its deletion, and unless it must be retained to comply with a legal obligation or for the establishment, exercise, or defence of legal claims. Data will be deleted using appropriate security measures to ensure either pseudonymisation or complete destruction.
If the user withdraws consent or exercises their rights of cancellation or erasure, their personal data will be blocked and made available only to the Judicial Authorities for the legally established periods in order to address any potential liabilities arising from the processing. Afterwards, the data will be securely deleted using appropriate measures to ensure pseudonymisation or full destruction.
DISCLOSURES AND RECIPIENTS OF PERSONAL DATA
All disclosures listed below are necessary for the fulfilment of the purposes described above, or are carried out in compliance with a legal obligation. Personal data may be disclosed to:
• Public Authorities and the Administration of Justice.
• IT service providers, including cloud computing services.
TRANSFERENCIAS DE DATOS A TERCEROS PAISES
As a general rule, your data is processed by service providers located within the European Union or in countries that have been deemed to provide an adequate level of data protection. However, in certain cases, in order to fulfil the purposes described above, specific companies providing services to Tertech Lab, SL may access your personal data (international data transfers).
Such transfers are made to countries with a level of protection comparable to that of the European Union (European Commission adequacy decisions, standard contractual clauses, as well as certification mechanisms). We will always ensure that whoever processes your information in order to help us provide our services does so with full data protection guarantees.
DATA SUBJECT RIGHTS
Users / clients may exercise their rights before Tertech Lab, SL, including the rights of access, rectification, erasure, and portability of their data, as well as the right to restriction of processing and objection to processing, and the right not to be subject to decisions based solely on automated processing of their data.
Likewise, users may withdraw their consent at any time where it has been given for a specific purpose, and may modify their preferences at any time.

THIRD-PARTY DATA
Our company will not collect or process personal data from children under 14 years of age without fully complying with the requirements established by applicable data protection regulations and EU Regulation 2016/679.
The processing of a child’s personal data shall be considered lawful when the child is at least 14 years old. If the child is under 14 years of age, such processing shall only be lawful if consent has been given or authorised by the holder of parental responsibility or legal guardianship over the child, and only to the extent that such consent or authorisation has been granted.
THIRD-PARTY PERSONAL DATA
If the personal data provided belongs to a third party, the User guarantees that they have informed such third party about this Privacy Policy and have obtained their authorisation to provide their data to Tertech Lab, SL for the purposes indicated. The User also guarantees that the data provided is accurate and up to date, and accepts responsibility for any direct or indirect damage or harm that may arise from non-compliance with this obligation.
CV PROCESSING
As stated in EU Regulation 2016/679 and Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights, candidates who provide their personal data are clearly informed at the time of collection about how their data will be used. For this reason, we provide this information in a clear and concise manner, and inform the candidate that they may request a copy of their data in a structured format.
We only retain up-to-date data; therefore, CVs that have not been updated for more than 24 months will be deleted or blocked to prevent access.
Tertech Lab, SL maintains a strict privacy policy regarding the data of individuals who have shared their CVs with us. The purpose of processing your data is to manage your job application and the recruitment process, which may include participation in various selection tests.
For this reason, we inform you that your data has been included in a processing register in order to allow participation in future recruitment processes. If your data changes, please inform us in writing. If you do not object in writing within 30 days, we will assume your consent for the above-mentioned processing activities.
COMMITMENT STATEMENT ON PREVENTION AND ELIMINATION OF DIGITAL HARASSMENT
Tertech Lab, SL is committed to data protection and gender equality and therefore undertakes to ensure respectful processing of personal data in accordance with the principles set out in data protection regulations, specifically Article 5 of the General Data Protection Regulation (GDPR).
We commit to preventing, raising awareness of, and taking action in cases of cyber harassment, whether workplace-related or sexual in nature.
Through this commitment statement, Tertech Lab, SL acknowledges the risks associated with the internet and ICTs in relation to such behaviours and promotes a culture of respect for personal privacy and awareness in the use of personal data.
Tertech Lab, SL expresses its strong rejection of workplace harassment and sexual or gender-based harassment, and its commitment to preventing and eliminating such behaviours. We firmly oppose any use of personal data that involves unlawful processing which could undermine the right to privacy and personal and family honour. We are firmly committed to the protection of personal data as a fundamental right and will minimise any processing of employee data that may increase the risk of harassment behaviours. We will also take into account the potential gender impact of any data processing carried out.
CONTENT OWNERSHIP
All content included on the Website, including trademarks, trade names, industrial designs, texts, photographs, graphics, logos, icons, software, or any other signs susceptible to industrial or commercial use, are protected by intellectual and industrial property rights owned by Tertech Lab, SL. Any use and/or reproduction without the express consent of the Company is strictly prohibited.
Tertech Lab, SL shall not be held responsible for any infringement of intellectual or industrial property rights of third parties that may arise from the inclusion on the Website of trademarks, trade names, designs, patents, texts, photographs, graphics, logos, icons, or software belonging to third parties who have declared ownership of such rights.
The User agrees to use the Website content diligently, correctly, and lawfully, and undertakes to refrain from:
1. Using the content for unlawful purposes or contrary to law, morality, good customs, or public order.
2. Reproducing, copying, distributing, or transforming content without authorisation from the rights holder.
3. Using the content to send advertising, direct marketing communications, or unsolicited messages, or to commercialise or disclose such information in any way.
In case of any dispute, both parties will attempt to reach an amicable solution. If this is not possible, the courts corresponding to the address indicated in the Legal Notice shall have jurisdiction, excluding any other jurisdiction.
